비영리학술저작물의 저작권정책과 오픈액세스에 관한 연구
A Study on the Copyright Policy and Open Access for Noncommercial Scholarly Works

본 논문은 2005~2007년 사이 국내에서 발생한 학위논문 및 학술논문과 관련한 저작권 분쟁 사건을 계기로 살펴본 향후 비영리 학술저작물에 대한 저작권법상 도서관 면책 규정과 이들 저작물에 대한 저작권 정책의 방향에 관한 것이다. 본 연구에서는 비영리 학술저작물의 속성과 현행 저작권법의 비판매용 저작물에 대한 규정을 근거로 학위논문을 포함한 비판매용 저작물이 저작권법 제31조 제5항에서 규정한 보상금 지급 예외에 포함되어야 함을 제안하였다. 또한 학술논문의 경우 저작권 신탁관리기관에 의한 불법적인 신탁 및 권리 행사에 대하여 해당 기관의 관리 감독청이 이를 통제가 필요가 있음을 밝혔다. 아울러 학위논문이나 학술논문은 그 저작물의 속성상 저작권의 강력한 보호를 통한 접근과 이용의 제한보다는 그것의 공개와 이용을 활성화시킬 수 있는 정부의 정책이 필요함을 지적하였다.

Abstract
This study is about the copyright policies by Korean government and the revision of the article 31 library exemption provision in the Copyright Act of Korea for noncommercial scholarly works considering through cases of copyright disputes occurred in Korea during the 2005~2007. This study proposes that works not for sale including thesis should be exempted from the copyright compensation in the article 31(5) in the Copyright Act of Korea based on the properties of noncommercial scholarly works and the regulations on works for not for sale in the current Korean copyright act. Also, this study reports that the copyright trust of scholarly articles by the copyright trust management agency is illegal in part and the government which has a duty to direct it has to control the illegal actions. Finally, this study proposes that noncommercial scholarly works such as thesis and scientific articles are to be open access and Korean government should develop open policies for them.
